Wedding Agreement

a. We understand the price list and the cost of the package selected and agreed.

b. It is understood that all negatives/digital files remain the property of Jonathan Suckling Photography. Jonathan Suckling Photography will not transfer possession or ownership of these negatives/digital files without our prior written consent.

c. We hereby assign the copyright of all photographs taken by Jonathan Suckling Photography to Jonathan Suckling Photography. However, we are granted a perpetual commercial license to use the photographic outputs (including all negatives, physical, and digital files) for any future biographical or autobiographical purposes, regardless of the medium of publication (e.g., physical books or digital distribution). Should we wish to use these files for a non-bio- or autobiographical purpose, we will first discuss that usage with Jonathan Suckling Photography. Jonathan Suckling Photography will not transfer ownership of this copyright without our prior written consent.

d. All care and diligence will be exercised in the performance of the above assignment and that the liability is limited to monies paid should mechanical failure, theft, accident or any other mishap occur which may prevent the fulfilment of this agreement.

e. Jonathan Suckling Photography is hereby retained as the sole and exclusive photographer to perform the photographic services requested hereon. The couple shall take necessary steps to ensure that this provision is enforced.

f. Upon signing, Jonathan Suckling Photography reserves the time and date agreed upon and will not make other reservations for that time and date. For this reason, all deposits are non-refundable.

g. The deposit shall be paid at the time of authorising this agreement with the balance to be paid prior to the wedding.

h. We understand that should the nominated photographer not be available for any reason, another photographer will be arranged and notify us immediately.

i. If we book the photographer for reception coverage, a meal provided for the photographer would be greatly appreciated. If not, responsibility cannot be taken for the photographer’s absence during the time the photographer seeks to make alternative meal arrangements.

j. Note, for the purposes of this agreement, all references to ‘we,’ ‘our,’ or ‘the customer’ refer to Oliver Badenhorst and Emily Chai.
